Case Study

London - Water Framework Contract

We assisted a main contractor through a challenging period of their project. A difficult Sub-contractor was holding up the completion of the project with multiple claims and there were many outstanding variations with the Client, affecting the financial security of the project for our Client.

After assessing the contractual position of the sub-contract, we consulted with the main contractor, outlined their contractual position, strategized and issued the contractually compliant notices to the sub-contractor. This assisted in the negotiation of outstanding claims under the subcontract and prompted them to focus on completion of their works to avoid delay damages exposure that we had substantiated. The subcontractor has since completed their works in full and a favourable final account was reached between the parties through assessment of the claims.

We also helped consolidate the outstanding variations with the Client and produce a proposal to produce an interim final account for the initial phase works whilst simultaneously agreeing the final phase of the project. This provided both parties with cost certainty and an agreement was reached and progression to the next phase was maintained as per the programme.
